Privacy Policy

1. Information We Collect
We collect the following categories of personal information:
a. Account Information
When you register for an account, we collect:
- Full name
- Email address
- Password (stored as a one-way cryptographic hash — we never store your plain-text password)
- Profile image (optional)
- Biography (optional, for artist profiles)
b. Usage & Listening Data
As you use the Service, we collect:
- Tracks played, including timestamps and approximate listening duration
- Playlists you create and their contents
- Track ratings and favorites
- Artist pages you visit
- Search queries and navigation activity within the Service
c. Technical & Device Data
We automatically collect certain technical information when you access the Service:
- IP address (used to estimate general geographic region; not used for precise geolocation)
- Browser type and version
- Device type and operating system
- Referring URL and pages visited within the Service
- Date and time of access
d. Studio Tool Uploads
If you use the Femo Studio tools (mastering, stem separation, noise reduction, etc.), we temporarily store your uploaded audio files on our servers for processing purposes. These files are automatically deleted within 48 hours unless you explicitly save them to your library. Files saved to your library are retained until you delete them.
2. How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve the Service, including streaming, account management, and Studio Tools
- Authenticate your identity and maintain the security of your account
- Personalize your experience (e.g., displaying listening history on your dashboard)
- Generate internal analytics about platform usage to improve content and features
- Detect, prevent, and respond to fraud, security incidents, and abuse
- Exclude plays by authenticated administrators from public analytics counts
- Respond to your inquiries and provide customer support
- Send service-related communications (e.g., account security alerts)
- Comply with applicable legal obligations, including the NY SHIELD Act and DMCA
We do not use your personal information to serve targeted advertising, and we do not sell your personal information to third parties for advertising or marketing purposes.
4. Data Security — NY SHIELD Act Compliance
Femo Music maintains a data security program in compliance with the New York Stop Hacks and Improve Electronic Data Security Act (SHIELD Act), N.Y. Gen. Bus. Law § 899-bb. Our security program includes the following safeguards:
Administrative Safeguards:
- Designated personnel responsible for coordinating the security program
- Risk assessment procedures to identify reasonably foreseeable internal and external risks
- Employee access limited to data necessary for their role
- Vendor and contractor oversight to ensure they maintain appropriate safeguards
Technical Safeguards:
- Passwords stored using industry-standard one-way cryptographic hashing (bcrypt)
- Access controls to restrict unauthorized access to systems containing personal information
- Network security controls including firewalls and encrypted data transmission (HTTPS/TLS)
- Regular monitoring for unauthorized access or use of personal information
Physical Safeguards:
- Secure hosting infrastructure with physical access controls
- Disposal procedures to securely destroy personal information when no longer needed
While we implement commercially reasonable security measures, no method of data transmission or storage is 100% secure. We cannot guarantee absolute security of your information.
5. Data Breach Notification
In the event of a data breach affecting your private information, Femo Music will notify affected New York residents in accordance with the NY SHIELD Act. Notification will be provided in the most expedient time possible and without unreasonable delay, and in no event later than the timeframe required by applicable law (generally within 30 days of discovery of the breach, consistent with N.Y. Gen. Bus. Law § 899-aa(8)).
Notification may be provided by email to the address associated with your account, or by alternative methods permitted by law where email is not reasonably practicable.
6. Data Retention
We retain your personal information for as long as your account is active or as needed to provide the Service. If you delete your account, we will delete or anonymize your personal information within a reasonable period, except to the extent we are required to retain it by applicable law or for legitimate business purposes such as fraud prevention, resolving disputes, and enforcing our agreements.
Listening history data (plays) is retained for analytical purposes and may be anonymized or aggregated after account deletion. Uploaded studio files not saved to your library are deleted automatically within 48 hours.
7. Your Privacy Rights
Depending on applicable law, you may have the following rights with respect to your personal information:
- Access: Request a copy of the personal information we hold about you.
- Correction: Request that we correct inaccurate or incomplete personal information.
- Deletion: Request that we delete your personal information, subject to certain legal exceptions.
- Portability: Request a portable copy of certain personal information you have provided to us.
- Objection: Object to certain processing of your personal information.
To exercise any of these rights, please contact us at legal@femomusic.com. We will respond to verifiable requests within a reasonable timeframe. We may need to verify your identity before processing your request. We will not discriminate against you for exercising your privacy rights.
Note: The New York SHIELD Act primarily establishes data security obligations rather than individual data access rights. Rights to access and deletion are provided voluntarily by Femo Music as a matter of best practice and may also be applicable to users in jurisdictions with consumer privacy laws such as the California Consumer Privacy Act (CCPA/CPRA).
9. Children's Privacy
The Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information without verifiable parental consent, we will take steps to delete such information in accordance with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq.

10. Notice to California Residents (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), may provide you with additional rights regarding your personal information. These rights include the right to know, delete, correct, and opt out of the sale or sharing of personal information.

11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, the Service, or applicable law. When we make material changes, we will update the Effective Date at the top of this page and, where appropriate, notify registered users by email. Your continued use of the Service after any changes constitutes your acceptance of the updated Policy.

This Privacy Policy is governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
